Jackson County Seeks To Shut Down TIF
Lawsuit Over Which Members Make Decisions On Commission
KANSAS CITY, Mo. -- A lawsuit filed Friday by Jackson County against the Kansas City Tax Increment Finance Commission asked the court to stop all TIF activity, at least briefly.
KMBC's Micheal Mahoney reported that the lawsuit asks for a temporary restraining order, preventing the TIF Commission from meeting, holding hearings, making decisions on potential TIF projects, amending current projects and diverting Jackson County money into TIF projects while the restraining order request is in court.
The county sued Kansas City on Friday, saying the city was breaking state law by having the six mayoral appointed TIF commission members make the decisions.
The lawsuit said state law requires 11 TIF members -- six from the city and five others from other taxing agencies that are affected, such as school districts or the county. Those members could be from the county government or school districts.
"To create two different classes of members is not right. I've never seen this anywhere else in Missouri, and there are hundreds of boards and commission in this state. But that what they're doing across the street," Jackson County counsel Joe Bednar said.
Bednar said he expects the county will have a hearing on its temporary restraining request early next week.
On Thursday, the City Council offered some resolutions promising to change the TFI commission membership soon, but Bednar said good intentions were not enough.
